Former Libyan leader Muammar Gaddafi’s son, Saif al-Islam Gaddafi says he wants to be tried for alleged war crimes in the Netherlands, and said a trial in Libya would be tantamount to murder.

In papers filed by defence lawyers at the International Criminal Court in The Hague, Netherlands, late on Tuesday, Saif al-Islam Gaddafi said there will certainly be no justice in the case if the prosecution is based on evidence from torture.

Saif says he is not afraid to die but if he is executed after such a trial, it should just be called murder.

The Hague court and Libyan government are negotiating where Saif's trial will take place for war crimes including murder and torture allegedly committed during the overthrow of his father's government.

He is being held in western Libya.
