On Friday the Anti-Corruption Commission was accused of abusing its office by arresting FCA Motors and Western Union franchise owner, Frederick Mtandah, who is facing over US$25 million fraud charges. Mtandah's lawyer, Mr Jonathan Samukange, made the accusation during the State's application to have the businessman surrender his passport, which was temporarily released.

Mtandah, who is also a major shareholder of CAPS Holdings, is appearing before Harare magistrate Mr Kudakwashe Jarabini.

To buttress its case, the State yesterday called the chief legal officer of the Anti-Corruption Commission Ms Monica Chizunza to furnish the court with the reasons why Mtandah should surrender his passport.

In her evidence in chief, Ms Chizunza said the State erred in consenting to the temporary release of the passport, hence the need to rectify the issue. Ms Chizunza also argued that there were changed circumstances warranting the return of Mtandah's passport.

"I am here to tell the court that the release of the passport was erroneous whether it was by consent or not, that is why I am here so the issue can be rectified," Ms Chizunza said. Anti-Corruption
