Uncle rapes minor (14) with mental health problems

A 28 year old Mutoko uncle who raped a 14 year old mentally ill niece was dragged to court last month.

Accused Pension Usayi appeared before Mutoko magistrate Jairosi Mutseyegwa who remanded him in custody waiting for trial at Murehwa regional court on 12 June 2020.

He is charged under section 65 (1) as read with section 64 (3) of the Criminal Law Codification and Reform Act Chapter 9.23 which is rape.

Prosecutor Nathan Majuru told the court that Usayi of Usayi village under Chief Mutoko is unemployed.
He is the cousin to the complainant (name withheld) to protect her identity as a minor.

Majuru told the court that on 23 May 2020 at around 17 00hours, the complainant arrived at home from the bush where she had gone to fetch some firewood.

Prosecutor Majuru told the court that she was raped in the family kitchen hut.

"Complainant proceeded to the accused person grass thatched kitchen to drink some water as she was feeling thirsty. As she entered the kitchen, accused was following her, closed the door after he entered into the house. It was then that he started fondling her breasts before undressing the complainant. He further went on to unzip his trousers and raped her once," Majuru told the court.

The state further alleges that accused person told the complainant to conceal the rape.

He threatened her claiming that she would be arrested by police if she dared to report the matter.

However, she could not take the threats seriously as she went to reveal the act to her mother Sanisai Gumbeze who was attending their vegetable garden.

The complainant together with her mother filed a police report with Mutoko police and a medical examination revealed that there was definite evidence of penetration and there is a psychiatric report that she is mentally challenged.

Magistrate Mutseyegwa did not ask him to plead but remanded in custody till 12 June 2020 when the trial will résumés.
