Sengezo Tshabangu withdraws his Supreme Court appeal

Interim Citizens Coalition for Change (CCC) Secretary General Sengezo Tshabangu has withdrawn his Supreme Court appeal against a High Court judgment that nullified his changes to the party's parliamentary leadership. As a result, CCC, led by Welshman Ncube, has reaffirmed the positions of its parliamentary deployees.

In a media statement released by CCC National Spokesperson W. Madzimure, it was announced that the High Court had heard the CCC's urgent chamber application to enforce Justice Wamambo's judgment. Just before the hearing, the party was served with a Notice of Withdrawal of Appeal by Tshabangu and Nonhlanhla Mlotshwa on their Supreme Court case number SC 12/25 against the High Court ruling in case number HCH 5606-24 and judgment number HH-11-2025, which was delivered on January 8, 2025.

This withdrawal effectively rendered the CCC's application for leave to execute the judgment moot, as per legal standards, and was subsequently withdrawn. The High Court has ordered Tshabangu and Mlotshwa to pay the wasted costs of the application.

Advocate Method Ndlovu represented CCC, while Advocate Lewis Uriri appeared on behalf of Tshabangu and Mlotshwa.




The ruling reaffirms the High Court's decision, which is now fully operational. This means that the reshuffle and deployment by Sengezo Tshabangu of elected members of Parliament to various portfolio committees are null and void, with no legal force. Consequently, the previously reshuffled Chairpersons of Committees remain in office.

Additionally, the removal of Hon. Lynette Karenyi and Hon. Edwin Mushoriwa from their ex officio capacities as Leader of the Opposition and Opposition Chief Whip, respectively, is unlawful and ultra vires the Constitution of Zimbabwe. Thus, both remain in their positions.

Furthermore, the appointment of Nonhlanhla Mlotshwa as overall Chief Whip is deemed unlawful and legally null and void.

This development ensures that CCC's parliamentary structure and leadership continue in their previous form, maintaining stability within the party's parliamentary operations.
