Property developer George Katsimberis, who faces accusations of defrauding his business partner in a failed $1 million joint venture, has been issued a warrant of arrest after failing to attend trial on Monday.
Katsimberis was scheduled to appear before Magistrate Vongai Guwuriro for a ruling on his application to refer the case to the Constitutional Court. The developer had argued that his constitutional rights were being violated due to the denial of a Greek interpreter, which he claimed was crucial for him to adequately participate in his defense.
His lawyer, Tinomudaishe Chinyoka, requested a postponement of the proceedings, citing that Katsimberis was admitted to the hospital. Chinyoka further stated that he was unsure when his client would be fit to appear in court.
However, the State opposed the postponement, urging the court to proceed with the trial without any further delays. The State emphasized that a ruling on the referral application could not be made in Katsimberis' absence.
Magistrate Guwuriro agreed with the State's position, deciding that the trial should not be postponed indefinitely. As a result, the magistrate issued a warrant for Katsimberis" arrest.
Katsimberis, who has been involved in a contentious legal battle over the joint venture deal, now faces the additional charge of failing to attend trial. His case has raised questions over the legal processes involved in his defense and the implications of his absence on the case"s progress.
