Security company demands $186 000 from Pioneer Transport

Peace Security Company (Private) Limited (Peace Security) has filed a $186 000 High Court lawsuit demanding the cash from Pioneer Transport (Private) Limited (Pioneer Transport).

The two parties entered into an agreement in November 2008 for Peace Security, formerly known as Comburry Investments (Private) Limited, to provide security services to Pioneer Transport (Private) Limited.

The court heard that Peace Security professionally and diligently provided security services to Pioneer Transport between 2008 until the end of January last year.

The agreement was terminated after Pioneer Transport allegedly failed to pay for services rendered.

"It was a fundamental term of the said service agreement that the agreed security fees shall be payable each and every month of the tenure of the contract and where there is failure on the part of the hirer (Pioneer Transport) to so pay, all amounts overdue shall…attract interest at prevailing bank rate…," the court heard.

The security firm told the court that Pioneer Transport failed to pay $186 022, 82.

"Despite several demands by the plaintiff (Peace Security) to the defendants for payment of the said long-standing amount of $186 022, 82, defendant has ignored, failed, refused and neglected to pay the said amounts," the court heard.

Pioneer Transport has responded through a special plea.

It argued that the issue being raised by the security firm had already been dealt with in a previous High Court case.

"Wherefore, the defendant prays that the plaintiff's claim be dismissed with costs on a higher scale," the transport company argued.

The matter is still to be finalised before the High Court.
