Malema battles for political survival

Johannesburg - Embattled Economic Freedom Fighters leader Julius Malema will embark on a battle for political survival on Monday as he starts to fight off sequestration in the Pretoria High Court.  
Should Malema lose the case and be sequestrated before the national elections, he will be unable to become an MP - a position he covets.
According to the Sunday Times, Section 47 (c) of the constitution prevents an unrehabilitated insolvent from serving as a member of parliament.
Malema's woes revolve around his unpaid tax bill and penalties of R16.2m for the years 2005 to 2011. According to SARS spokesperson Adrian Lackay, SARS is ready to proceed with the case on Monday.
It is not however clear whether Malema's lawyers will push for a postponement. SARS meanwhile states that Malema's liabilities far exceed his assets and that he is factually insolvent.
