THE Matero Local court heard how a 23-year-old man of Lilanda township admitted having sex with his ex-girlfriend but denied impregnating her.
Jane Mumbi, 21, also a resident of Lilanda township sued Gasper Shimukuni for child maintenance.
She told Senior Court Magistrates Lewis Mumbi and Petronella Kalyelye that she met Shimukuni in 2011 while she was selling groundnuts on the streets of Lusaka.
Mumbi said Shimukuni dated her for a month adding that it is during this time that they had sex on many occasions.
"He never even used condoms whenever we had sex. When I fell pregnant I informed him about it but he denied responsibility and stopped communicating. When we were dating he promised that he would marry me," she said.
Mumbi told the court that Shimukuni has not made himself available for family discussions.
"I just want him to support his child financially because I cannot manage on my own," she said.
Shimukuni admitted having sex with Mumbi but that it was only once that he did not use a condom.
He told the court that he met Mumbi while he was drinking with friends in a bar and not on the streets.
"I never used protection on one occasion then, she claimed I impregnated her," Shimukuni said.
He claimed Mumbi was also having sex with another man at the same time he dated her.
The court ordered Shimukuni to pay K150 monthly as child maintenance and that a DNA test be conducted to determine the paternity of the child.
