Lawyers in the Comesa urged to utilise the bloc's court

Lawyers within the Common Market for Eastern and Southern Africa Comesa have been urged to utilise the b,loc's newly opened court on interrnational disputes.
The remarks were made during COMESA Court of Justice inaugural court session for the new Judges of the First Instance Division. Judge President Lady Justice Lombe Chibesakunda called for legal practitioners from the region to make full use of this Court as an international dispute resolution tribunal.
Justice Chibesakunda said only when lawyers from the region use the Court, will it achieve its mandate in the integration process.
She was speaking when she officially opened the session.
"I am delighted to welcome you to this inaugural court session. To the Judges of the First Instance Division presiding, the work has now began and I wish you well as you execute your new mandate as Judges of the COMESA Court of Justice," Lady Justice Chibesakunda said.
She reiterated the Court's commitment to upholding and promoting the rule of law through an accessible, fair, timely and transparent adjudication process.
In this inaugural session the First Instance Division is receiving submissions in a case between Malawi Mobile Limited versus the Government of Malawi and the Malawi Communications Regulatory Authority (MACRA).
"The new Bench took office in June this year and this reference, filed in May is the first one to be heard by the court. The fact that we have been able to set it down for hearing within which a short period of time goes to show that this Bench is committed to ensuring that there is minimal backlog."
The quorum is made up of Honourable Lady Justice Qinisile Mabuza who is the Acting Principal Judge, Justice Ali Sulaiman Mohammed, Lady Justice Mary Kasango, Dr Justice Leonard Gacuko and Lady Justice Clotilde Mukamurera.
