A decision by a 27-year-old woman to share a bed with a stranger for the whole night resulting in her being raped and this saved the man convicted of the offence from spending more years in prison.
Meshack Morapedi (33) of Block 7 in Francistown had pleaded not guilty to a single count of rape before Francistown magistrate Sijabuliso Siziba but was found on the wrong due to overwhelming evidence by the state.
The court proved that sometime mid last year, Morapedi had sexual intercourse with a 27-year-old woman, without her consent at his lodgings in Block 7 location.
The Voice reported that Morapedi was faced with the mandatory ten-year jail term usually imposed on convicted rapists but will instead serve six years as Siziba blamed the victim for her behavior.
The magistrate accused the victim of not taking into cognisance the fact that she could be raped if she walked at night with a stranger let alone spending the night with him.
Though it is not clear where the two met and why the victim decided to sleep at Morapedi's lodgings, it is before the courts that the two shared a bed and that the former slept naked.
"The victim in this matter conceded to sharing the bed with Morapedi," said the magistrate adding that was an indirect yielding to having sexual intercourse with Morapedi.
Siziba also said the victim saw the signs of possible rape but still did not seek alternative accommodation.
"As he jumped into bed, Morapedi palmed the victim's uncovered buttock, these were sexually suggestive advances and the victim dismally failed to seek an alternative accommodation," he said.
He then sentenced Morapedi to six instead of 10 years behind bars.
