A BULAWAYO man left the court in stitches after he confessed that he stole two donkeys to fix his former employer who had defaulted in paying him his dues.
When asked about why he committed the offense, Thembelani Mkhwananzi replied:
"I performed some work for Ncube but he did not pay me. I reported the matter to the members of the neighborhood watch committee and they did not take any action. I intended to sell the property so as to recover my money the complainant owed me," he said, sparking a roar of laughter in the gallery.
Mkhwananzi residing at plot 8 Dunstal farm Upper Rangemore in Bulawayo was lucky to get a suspended sentence and community service after the presiding magistrate in the matter, Themba Chimiso slapped him with 12 months imprisonment of which six months are suspended on condition that he pays the complainant a restitution of $US150 by March 30.
He had the other six months suspended also on condition that he does 210 hours of community service at Rangemore Primary School, which he has to complete within six weeks.
The state case against Mkhwananzi (26) is that he contravened section 114 of the Criminal Law Codification and Reform Act chapter 9:23 (stock theft) when he unlawfully possessed the two domestic animals.
Circumstances are that on 28 January this year â€" the complainant - Dumisani Ncube, of Plot C5, along Josephyn road, upper Rangemore, Bulawayo put his donkeys in the kraal and closed the door.
When he checked his kraal the following morning he discovered that two of his donkeys were missing although the door was closed.
The court further heard that the complaint searched for the donkeys around his compound. In the process he met Mkhwananzi who he asked about the donkeys and the former got infuriated and threatened to stab him with a kitchen knife.
Ncube reported the matter to the police leading to Mkhwananzi's arrest.
Upon interrogation by the police Mkhwananzi admitted to stealing the donkeys and selling them to another person. The value of the stolen livestock is US$300. Only $150 and one donkey was recovered.
