A man accused of murdering an elderly man staying alone in Bulawayo's Pumula North suburb and later burying the body in a shallow grave in the yard yesterday stunned the court when he claimed the old man had over the years sodomised him.
At his initial appearance yesterday, Daniel Sinkala told Bulawayo provincial magistrate Mr Shepherd Mjanja that each time the late William Longwe would have anal sex with him he would pay him $50.
He said events leading to the killing of the old man were that after having anal sex with him twice, Longwe told him that he did not have money to pay him.
It was then that he decided to kill him and sell his property so that he would get his $50.
Sinkala (24), of House Number 687 New Luveve, was not formally charged with murder as defined in Section 47 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.
He was remanded in custody to 7 August and was advised to apply to the High Court for bail.
He had his warned and cautioned statements, which he made to the police after his arrest, confirmed meaning they can be used in a trial court as evidence.
Mr Masimba Saruwaka for the State told the court that on 13 July this year, Sinkala proceeded to House Number 6928 Pumula North where Longwe was staying alone.
At about 6pm, Sinkala and Longwe had a misunderstanding over a $50 debt. While seated in the kitchen, Sinkala got up and went to the toilet where he took a pick head, came back and allegedly struck Longwe twice on the head and killed him instantly.
To cover up the offence, the State alleges that Sinkala dug a shallow grave about a metre deep in Longwe's garden where he buried the body.
Sinkala went away and came back to Pumula North on 15 July at about 10 am and allegedly stole a double bed set, wardrobe, three heavy-duty sewing machines, wooden kitchen cupboard, a fridge, two by two-in-one blankets, a comforter, Phillips DVD, a pillow case and a grey speaker and loaded the property into a Mazda pick-up truck Registration Number ABC1979, which he had hired.
An alert neighbour on seeing that Longwe's property was being taken away took down the registration number of the truck.
Longwe's church mates, on noticing that he had missed church on 15 July, became suspicious and made a report of a missing person at Pumula Police Station.
Another neighbour had noticed a pit in the late Longwe's yard on 14 July, which had been filled up the following day.
Police armed with this information dug up where the pit had been seen leading to the discovery of Longwe's body.
Follow-ups on the vehicle that had carried the property led to its owner and he led the detectives to Sinkala's house where he was arrested on 19 July.
He allegedly led to the recovery of some of the property at his home while part of it was found at House Number 142 New Luveve where he had left it for safekeeping.
