Andre Zeitsman, the Bulawayo businessman, who has been locked in a property wrangle with Mutare-based bus operator Esau Mupfumi has made an out-of-court settlement to resolve the dispute and the agreement was signed on September 20, 2012.
The agreement was reached by lawyers representing both parties. Mupfumi will now lease part of the property, a garage, for overnight parking of his buses.
Zeitsman had sued Mupfumi in the High Court for allegedly breaching a contract to purchase a garage in Harare priced at $620 000.
According to court papers, when Mupfumi bought buses and trucks for $3 million from Zeitsman, he offered to buy a garage in Msasa which belonged to Zeitsman.
Mupfumi is allegedly did not honour his promise, but continued to use the garage without paying rent for the use of the property.
Both Mupfumi and Zeitsman confirmed the agreement that led to the withdrawal of the case in the High Court.
"To my understanding, there was never a dispute. Zeitsman just rushed to the courts and now we agreed that he withdraws his application and allow me to use the garage for my overnight parking in Harare," said Mupfumi.
