Married woman drags polygamous ex-hubby to court for maintenance

A Bulawayo woman has dragged her polygamous former husband to court claiming $450 per month as maintenance for herself and her three minor children. Mrs Magret Ndlovu, age not given, but residing at number 413 New Luveve, separated with her husband Mr Shepherd Ndlovu four years ago but they did not divorce.

She told Bulawayo magistrate, Ms Charity Maphosa at the Maintenance Court housed at Tredgold Building that she is now married to another man while her husband is also now married to two women.

Mr Ndlovu has three children with the two other women.

Mr Ndlovu and Mrs Ndlovu have three minor children aged between nine and 14 .

Mrs Ndlovu approached the Maintenance Court seeking an order for Mr Ndlovu to take care of the children.

Mrs Ndlovu said for the four years they had separated, Mr Ndlovu did not do anything for her and the children.

She told the court that she was finding it difficult to provide for the minor children because she was surviving on buying fish for resale, which was giving her a profit of $60 per month.

Mrs Ndlovu said she was demanding $150 for herself and $100 for each child.

She said the money was meant to cater for groceries, medical expenses, school fees, uniforms and transport to school for the children, clothes, rent, and bills.

Mr Ndlovu offered to pay $50 per month, saying he was not gainfully employed as he was a vendor selling farm produce.

He said he was realising between $100 and $150 per month.

"I get only $150 and I can offer to give her $50 and as for the children I am paying school fees for them," said Mr Ndlovu.

However, Mrs Ndlovu said he had lied before the court as the children were not going to school because they had not paid fees.

Ms Maphosa told Mr Ndlovu that his new marriage was illegal because he was still legally married to Mrs Ndlovu.

The couple married under Chapter 37, now Chapter 5:11. Said Ms Maphosa to Mr Ndlovu: "Your new marriage is not valid because you are still legally married to your wife. You are legally married to her and you are expected to meet all her expenses and these are rent, food, water and electricity bills and clothes."

Mr Ndlovu told the court that it was not the first time his wife had brought him to court prompting the magistrate to postpone the matter to 17 July when proceedings of the previous order is expected to be availed.
