A 24-year-old Bulawayo man facing an assault charge had the court in stitches when he went down on his knees and even offered to show a female magistrate his injured private parts in a bid to avoid remand prison.
"Your Worship, please don't remand me in custody I have injuries on my private parts. I am in so much pain such that I cannot endure the conditions of remand prison and I can even show you the wound," Mthokozisi Ncube pleaded with Western Commonage magistrate Tancy Dube on Friday.
When Dube asked Ncube what had happened to his private parts, he responded: "Your Worship, I arrived home late on December 19 and I was drunk. I accidentally stepped on mud resulting in me slipping and in the process I fell on a barbed wire and my private parts were ripped open."
Dube was not convinced and she had to order a prison officer to take Ncube back to the cells for examination.
It however, turned out that Ncube had indeed sustained serious injuries on his private parts.
The magistrate then remanded him out of custody to January 6, 2014 for trial. He pleaded not guilty to the charge of assault.
Prosecuting, Frank Ncube, told the court that on December 23 at about 8.00pm, Ncube met the complainant, Alex Mumpande at Malaba Shopping Centre in Old Lobengula.
Mumpande was crying when Ncube allegedly confronted him demanding to know what had happened.
The court was told that Mumpande continued sobbing without saying a word and Ncube got angry and allegedly struck the complainant with a stick on his head before slapping him across his face several times.
Mumpande sustained a deep cut on his head and a swollen face.
He reported the matter to the police leading to Ncube's arrest.
