A BULAWAYO man has resigned from work four times in a bid to avoid paying maintenance for his three year old daughter.

His girlfiend Abigail Gashu told magistrate Vimbai Mtukwa yesterday that his ex-lover Gideon Cheure was defaulting paying maintenance despite being ordered to do so by the court two years ago.

She said Cheure was ordered to pay her $70 maintenance per month in 2011 and has not paid anything to date.

Gashu asked the court to garnish Cheure and force him to deposit the money into her account.

"Your Worship, this man hasn't been paying maintenance since 2011. He only paid for four months and he's now in arrears of $1,960.

"He's always resigning from work to avoid paying maintenance. So far he has resigned from four jobs and once ran away to Musina. He blocked all my cellphone numbers and I didn't know where he stays until a friend told me," she said.

"His daughter is now three years old  and he is not taking care of her. When I give him summons from court he resigns from work so as to fix me. He has also threatened to resign from his current job.

"At times he sends people to threaten me so that I don't report him. I am now applying for a garnish order so that I stay away from trouble."

In mitigation, Cheure said he resigned from work because he was not earning much.

"Your worship, I resigned so as to look for greener pastures. I agree that I've been moving from place to place but it's not on grounds of avoiding maintenance but to search for what is best. I am permanently employed now and I'm hoping to stay there. If she wants a garnish order she can go for it," said Cheure.

The magistrate granted Gashu the garnish order and ordered Cheure to pay all the arrears by end of April and continue paying maintenance for his child.
