'I don't have red panties'

A Bulawayo woman who is accused of sexually abusing a seven-year-old boy on Monday told the court that she did not have red underwear that the child claims she wore on the day she allegedly committed the offence.

Gugulethu Mpofu of Lobengula Township said this when she appeared before Regional Magistrate Mark Dzira at the Tredgold Magistrates' Courts and is pleaded not guilty to  aggravated indecent assault.

During cross examination by the state prosecutor, Tinashe Dzipe, Mpofu denied ever wearing red underwear on the day in question.

"There is no way I could have abused the child; I have never spoken to him. I don't even have a red pant, I have never worn a red pant," she argued.

"I never spoke to the complainant; I used to talk to his grandmother and his sister who is now in South Africa."

On a day unknown to the prosecutor, but during the period between 2009 and 2010, the 18-year-old woman allegedly ordered the little boy who she called to her house for snot apples and a pen to undress while she also removed her red pant and lied on the floor with her legs open.

She allegedly asked the boy to lie on top and forced him to make some sexual movements.

Gugulethu yesterday said although she was still staying at her family house in Lobengula where the offence was allegedly committed between the period 2009 and 2010,  there was no way she could have managed to commit the alleged crime as there were always other people at the house.

"We have tenants at home and they have children. Most of the time there would be children playing within the yard. I do not recall remaining on my own at that house," she said.

The matter reportedly came to light when the grade two child started poking his classmates with his penis during lessons at a school in Lobengula.

The class teacher yesterday testified in court that the pupil started making sexual gestures to his classmates, which led her to question him.

Magistrate Dzira will deliver judgment on the matter on Tuesday.
