Top lawyer dupes woman of house

A SENIOR Bulawayo lawyer has been sucked into a fraud scam after allegedly forging documents used in duping a city businesswoman of her house.
According to Chronicle, Godfrey Nyoni, 32, a partner at Moyo and Nyoni Legal practitioners, allegedly connived with Given Nyathi, 50, and Virginia Mambo, 38, to dupe Effie Dewa.
Nyathi and Mambo have already been remanded on the matter after appearing at Bulawayo's Tredgold magistrates courts while Nyoni is expected to join them on their next appearance next week.
The trio faces two counts of forgery each.
Allegations are that on August 15 in 2007 at Majoko and Majoko Partners where Nyoni was a legal practitioner during the time of the suspected offence, Dewa entered into an agreement with Nyathi where she sought to exchange her house in Queens Park suburb for his restaurant.
However, Dewa later realised that the agreement was a barter trade centred on the restaurant business only excluding the building. She then made efforts to reverse the deal.
When the three discovered that Dewa intended to reverse the deal, they allegedly connived to draft some forged documents so that they could facilitate a change of ownership of Dewa's house.
The three changed the ownership of the house into that of Nyathi's wife without Dewa's knowledge, the court will seek to prove.
On August 27, the three allegedly met at Majoko and Majoko Legal Practitioners.
Mambo was Nyoni's secretary at the time.
Nyoni then allegedly instructed Mambo to draft a computer generated document written, "To Whom it may Concern".
They purported the letter was produced by Dewa instructing Ben Baron and Partners, who were in custody of her title deeds, to release them to Nyathi or his wife for tax purposes. This was despite the fact that Dewa had not authenticated the document.
The three, or one or more of them, allegedly inserted a signature making it appear as if it was Dewa who had signed the document.
On the following day, the three met again at Majoko and Majoko where Nyoni allegedly instructed Mambo to draft a computer generated document which is a power of attorney.
One or more of them inserted a signature that made it appear as if Dewa's Queens Park house had been transferred into the name of Nyathi's wife.
The forged power of attorney was recovered together with the letter addressed "To Whom It May Concern". Both documents will be produced in court as exhibits.
