Couple up for theft of over $10k from physically challenged mother

A 32 YEAR old woman and her husband (29) were slapped with 350 hours of community service and ordered to restitute the husband's visually challenged mother her $10 600 which they stole.
Jessina Mugabe and her husband Raymond Mkhwananzi both of Nkulumane 12 in Bulawayo pleaded guilty to a charge of stealing from Cynthia Mkhwananzi (54) also of Nkulumane 12 when they appeared before Bulawayo magistrate Gladmore Mushove.
Cynthia is the mother to Raymond while Jessina is her daughter in law. The magistrate convicted and sentenced both of them to 24 months in jail. Six months of the sentence were suspended for five years on condition of good behaviour. Nine months were suspended on condition they restituted their mother $5300 each. Mushove also suspended another nine months on condition the two performed 350 hours of community service.
This was after their mother during mitigation pleaded with the court to forgive them saying what she wanted was her money.
"In sentencing you the court considered that you pleaded guilty to the charge you did not waste its time," said Mushove. "The court also considered that the first accused (Jessina) is the daughter-in law to the complainant while the second accused is first accused's husband and you have two children. You said you are working and willing to reimburse the complainant's money.
"The complainant also told the court to forgive you saying what she wants is her money back. But what is wrong is that you two stole from your mother. She had given you first accused money to take to the bank and you decided to divert it. If it were not for the complainant's plea you could have been jailed."
The prosecutor Jeremiah Mutsindikwa told the court that sometime in 2013, the complainant and the two were staying together at Nkulumane 12. Jessina was most of the time sent by the complainant to deposit cash into her account.
It is the state case that on September 2013, Cynthia together with Jessina went to the bank to check the balance and it was $10 600. Cynthia was assisted by Jessina because she cannot see properly and in the year 2014 she did not do any withdrawal.
On February 12, 2015 Cynthia sent her daughter Sharon Mkhwananzi to the bank to check for her the balance as she wanted to buy a house. Sharon discovered that there was only 95 cents in the account.
Sharon told her mother about the developments. Sharon and her mother went back to the bank where they were told that the money was withdrawn on different occasions and were issued with a bank statement.
When they went back home they found her daughter in law having ran away to South Africa. Jessina while in South Africa phone her mother in law confessing that she is the one together with her husband Raymond who stole the money. Cynthia reported the matter to the police leading to their arrest. The total money stolen was $10600 and was not recovered.
