A movie scene inspired a rape victim to lure her rapist to come back for a ‘second session' as a ploy to positively identify him.
Bulawayo Magistrate, Trynos Utawashe heard that on 30 October last year, at about midnight, one Lungisani Mabhena waylaid Lister Setoboli of house number 30393 Entumbane before she got home and raped her once.
In a feat reminiscent of a movie script the rape victim, soon after the act asked Mabhena to "come back for more " the next day and little did Mabhena know that it was a trap to have him identified.
As fate would have it, the unsuspecting rapist did come and as he arrived to see Setoboli as agreed, he met the complainant's tenant Josline Mkwananzi and told her that he was looking for Setoboli.
This is the time when the complainant peeped through the gate and saw the man who had raped her and then called neighbours leading to Mabhena's arrest.
When asked where she had got the courage to invite the accused over, Setoboli told the court that she had seen the moves from movies.
"I had watched it from movies that I had to act calm", said Setoboli.
The accused pleaded not guilty to the charge of rape as defined in section 65 of the Criminal Law (Codification and Reform) Act chapter9:23
In his defence Mabhena told the court that he is not guilty as he was at a funeral the night Setoboli was raped.
"I had attended a funeral and after that we went on to drink with my friends," said Mabhena.
The case is expected to proceed soon with one of Mabhena's witnesses, only known Z from Entumbane suburb set to give evidence.
Prosecutor Robin Mukura represented the state.
