Company director gets 1050 hrs community service for forgery and theft

The Co-director of Full Scap Investment trading as a car dealing company situated at corner Robert Mugabe Way and 12 Avenue in Bulawayo has been slapped with a total of sentenced to a total of effective 1050 hours of community service for fraudulently withdrawing $13 500 from a the company's account.
The accused and the other co-director were signatories by forging his colleague's signature on the withdrawal slips.
Philip Matutu (39) of South World in Bulawayo pleaded guilty to the charges of theft and fraud when he appeared before Bulawayo senior magistrate Sibongile Msipa Marondedze.
The magistrate convicted him on both counts and sentenced him to 3 years for theft. She suspended six months for five years on condition of good behaviour. Further 12 months were suspended on condition that he completes 420 hours of community service. The remaining 18 months were suspended on condition he restitute the company the amount stolen.
In the fraud case the magistrate sentenced him to 5 years in jail. Twelve months of the sentence were suspended for five years on condition of good behaviour. Twenty-four months were suspended for 630 hours of community service. The remaining 24 months were suspended on condition he restituted the company the money he defrauded.
The prosecutor Charles Danda told the court that July 29, 2013 the co- director who is not stated in the court papers sold a Toyota Prado to one Bekezela Moyo for $18 000. Moyo was to deposit the money into the company's account.
On August 5, 2013, Matutu went to the CBZ bank in Belmont and completed withdrawal slip withdrawing $13500 before forging his co director's signature on the slip purporting that he had endorsed the withdrawal. He then handed the slip to the bank clerk before he was given $13 500. The offence was discovered when the co-director (complainant) asked Matutu to go with him to the bank. He discovered that there has been a withdrawal and his signature was forged on the withdrawal slip.
The matter was reported to the police leading to the arrest of Matutu.
