A MAN from Kabela village in Lupane was found in the act of raping a mentally ill woman the victim's mother who gave the man a serious beating and head butted him.
This was head by Hwange Regional Court magistrate Dambudzo
Maliunga when Mgcini Sibanda (34) appeared before the court charged with rape.
The court heard that on May 27 2012 at 4pm the woman aged 34 was going home along a path and passed through a place where Sibanda was drinking beer. Sibanda allegedly followed her and caught up with her before asking her if she remembered that she was his wife but the woman disputed the claim.
It is the State case that Sibanda allegedly dragged her into the nearby bush where he forced her to lie down before raping her and told her never to tell anyone about the incident, but was unfortunate when the woman's mother found him on the act.
The mother attacked Sibanda with a switch and head butted him three times on the nose before beating him with clinched fists. The matter was later reported to the police but Sibanda allegedly disappeared since then until he was arrested recently and first brought to court last week.
The rape victim is a confirmed mentally patient.
During trial Sibanda argued that he would not sleep with a mental patient and disputed the allegation that he was beaten by the woman's mother.
But the woman's mother bragged in court saying to him, "I damaged you very much you were bleeding from the nose and mouth and your shirt got bloody soiled. You had tried to fight back but I over powered you."
