IVY Granger of 1427 Nkulumane is suing Muchanheta Zonde who is alleged to have stolen their family house Title Deeds that he later used as collateral in getting a loan of $3 125.
In an interview, Granger said her family has suffered a lot from Zonde's actions, who is alleged to have stolen their mother's Title Deeds that were in possession of his late wife Portia Masuku.
"Zonde was married to my sister who was in possession of late Violet Granger's title deeds by the time she passed away.
"Zonde went on to use our Title Deeds to acquire a loan of $3125 as he had stolen them from Portia," she said.
Granger said they were surprised to see the messenger of court who ordered them to get out of the house as Zonde had failed to settle the debt.
"We only got to know about the issue when the messenger of court came to evict us. For the first time he told us that Zonde had used our mother's title deeds to get a loan that he has failed to settle," she said.
Granger said they have decided as a family to sue Zonde as they spent the whole of last week sleeping outside and some of their property was destroyed during the eviction.
"As you know Zonde is already serving his jail term in the form of community service and once he is done he will be free which will not be fair on our part.
"During the eviction my property that includes fridges and stoves was broken down in the process," she said.
Granger said on the second eviction they suffered humiliation as the messenger of court threw out their clothes on the road and they mixed soap with their food staff, which left them stranded.
"Our private clothes like pants flew left, right and centre and we have small children who slept outside for four days and with that we are demanding out Title Deeds and the repairing of the broken property," she said.
B-Metro spoke to Tavengwa Hara of Hara and partners who represented Zonde over the matter. He said they had encouraged Miss
Granger to come with her son -in- law to talk about the matter but they never came.
"I was the first person to advise Granger to report her matter to the police as fraud and after that I urged her to come with Zonde to make an arrangement to get her Title Deeds back.
"As for the eviction being illegal they are being represented by the lawyers they can contest that in court and we are going to continue holding on to the Title Deeds up to 30 September as Zonde is expected to have cleared the debt by then," he said.
