THE Bulawayo City Council (BCC) has dragged Amakhosi Theatre Productions to court over a debt of more than $86,000 in unpaid refuse collection and water charges.

The BCC last week filed summons at the Bulawayo High Court seeking an order compelling Amakhosi Theatre Productions to settle $86,052,76 accrued over a period of two years.

The municipality through its lawyers, James Moyo-Majwabu and Nyoni legal practitioners, accused the organisation of deliberately neglecting to pay the money despite demand.

In papers before the court, the BCC is the plaintiff while Amakhosi Theatre Productions was cited as the defendant.

Amakhosi Theatre Productions is the registered owner of a property situated between Basch Street and Old Victoria Falls Road in Bulawayo.

"Between March 31, 2011 and March 2013, the plaintiff levied the defendant the sum of $86,052,76 for the provision of water and refuse collection. Despite demand the defendant has failed or refused to pay the money," said the council in its summons.

The council is seeking an order compelling Amakhosi Theatre Productions to pay the money with interest calculated at the prescribed bank rate from March 31, 2013 to the date of full and final payment.

Amakhosi Theatre Productions has not yet filed a notice of appearance to defend the summons.

BCC has resorted to taking defaulters to court as the cash strapped local authority seeks to recover money owed for rates and water charges.

The council is being owed millions by residents, companies and government departments.
