Lawyers sue Kasukuwere over Harare mayor suspension

Zimbabwe Lawyers for Human Rights on Thursday sued Local Government Minister Saviour Kasukuwere over the suspension of Harare Mayor Bernard Manyenyeni.

ZLHR lawyers David Hofisi and Dzimbabwe Chimbga have filed an urgent application at the High Court on behalf of Harare Mayor Bernard Manyenyeni seeking an order setting aside the suspension of Councillor Manyenyeni by Local Government, Public Works and National Housing Minister Saviour Kasukuwere and allowing him to continue carrying out council business and receive allowances in line with his post of Mayor.

The human rights lawyers also want the High Court to order Minister Kasukuwere to refrain from suspending, dismissing or engaging in any other activity with a view to removing Councillor from the office of Mayor of Harare.

Councillor Manyenyeni was suspended to serve as Mayor of Harare and councillor on Wednesday 20 April 2016.

In an urgent chamber application filed on Thursday 21 April 2016, Hofisi and Chimbga argued that in terms of the Constitution of Zimbabwe, removal of mayors, councillors and chairpersons is done by an independent tribunal in terms of an Act of Parliament and there is neither that Act of Parliament nor an Independent Tribunal hence Minister Kasukuwere has thus arrogated to himself powers he no longer has in violation of the Constitution of Zimbabwe.
