Mbanje addict kills father

A man from Mkoba 6 in Gweru who killed his father in 2012 has escaped a jail term after doctors discovered that he was a mbanje addict who was mentally unstable at the time that he committed the crime.
According to Masvingo Mirror, Cloud Alick Banda who resides in Mkoba 6 appeared before High court Judge Nokuthula Moyo last week on Monday facing murder charges.
In passing sentence, Moyo noted that the accused person was examined by a psychiatrist at Doctor Poskotchiwa and Mlondolozi Special Institution on several occasions and concluded that at the time of the commission of the alleged offence the accused was suffering from a mental disorder, epilepsy alcohol and cannabis abuse.
Cloud Alick Banda who resides at house number 4778 Mkoba 6 killed his father Aliki Dary Banda on December 8 2012 at around 2200 hours after they had an argument over the issue of the accused person coming home late.
Cloud Banda pleaded guilty.
It is the State's case that the accused person took an iron bar and hit the now deceased with it four times on the head.
It is alleged that the deceased fell to the floor at the door of his bedroom bleeding profusely and died.
It is also the States case that the accused person went to Mkoba police station leaving the deceased lying on the floor, while on the way he met Constable Muzumbi and narrated how he had assaulted the deceased.
The court heard that the accused person and Muzumbi went to the deceased home where Muzumbi discovered that the deceased had already died. Then constable Muzumbi arrested the accused person and took him to Mkoba police Station.
On December 11 2012 Doctor Pesanai examined the remains of the deceased and conducted that the cause of death was massive subarachnoid hemorrhage, multiple skull fracture , blunt force trauma and homicide.
The State concedes to the fact that the accused was suffering from a mental disorder at the time of the commission of the alleged offence and it is appropriate for the court return a special verdict of not guilty because of insanity.
The accused escaped jail and was taken back to Mlondolozi Special Institution.
Yeukai Mugumba prosecuted.
