Kombi owner assaults cop over spot fine

A LOCAL commuter omnibus owner allegedly assaulted a police officer after his driver was asked to pay a spot fine.Johannes Nyamuda (52) was remanded to June 17 when he appeared before Mutare senior magistrate, Langton Mukwengi last week.
He is facing charges of assaulting and resisting arrest as defined in Section 176 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.
Manica Post reported that Nyamuda is also facing an alternative charge of defeating or obstructing the course of justice as defined in Section 184(1) (g) of the Criminal Law (Codification and Reform) Act, Chapter 9:23.
He was not asked to plead.
It was the State's case that on June 1, Constables Zvamachena and Marufu, together with Sergeant Mangezi were carrying out spot checks in Dangamvura when Cst Marufu stopped a Valley Express commuter omnibus.
"The driver failed to produce a driver's licence and after inspection, the police officer also discovered that the vehicle had no certificate of fitness. The driver was ordered to pay a $35 spot fine," said Karombe.
It was further alleged that the driver then called Nyamuda who is the owner of the commuter omnibus.
Said Karombe: "When Nyamuda arrived he started assaulting Cst Marufu.
"He pushed him off the road, snatched a spike he was holding and threw it away, thereby clearing the road for his commuter omnibus to pass. He ordered his driver to drive away."
