Man's manhood pulled in domestic dispute

THERE was drama in Mzilikazi when an 18-year-old man cheated death by a whisker after being pulled and uplifted by his manhood for a distance by his uncle before being thrown to the ground following a heated domestic dispute.

The fracas, which nearly turned fatal, was heard during the initial appearance of Ronald Niwa (25) of Number M24 before Bulawayo magistrate Mr Tawanda Muchemwa. He was being charged with physical abuse as defined in section 4 as read with section 3 (1) (a) of the Domestic Violence Act Chapter 5:16.

Niwa however, pleaded guilty to the offence. The State case as presented by prosecutor Mr Malvern Nzombe was that Niwa committed a crime of physical abuse which could sexually maim his cousin Tafadzwa Niwa when he pulled and uplifted him by his manhood. Mr Nzombe told the court that on 5 November at around 4 pin the accused and the complainant had a misunderstanding over unknown issues. Following the heated altercation, the two parties exchanged harsh words leading to the accused person who was seething with anger to run amok assaulting the complainant with open hands several times on the face.

The daring accused person, not yet done with the onslaught on his nemesis, went on to pull the complainant's genitals dragging and uplifting him for distance before throwing him to the ground. During the process, the court further heard that the complainant was shouting for help thereby drawing the attention of other residents who later came to his rescue.

The complainant who sustained no visible injuries but excruciating pains on his manhood went and reported the matter to the police leading to the arrest of the accused person. The apologetic Niwa who appeared perturbed in the dock was later spared the humiliation of a trial when the complainant decided to withdraw the charges before plea. In withdrawing the matter, the complainant in his founding affidavit stated that the accused person had repeatedly begged for forgiveness from him claiming that he would never do it again.
