Court told what a principal is

A RENOWED advocate today defined what a principal in the context of the Global Political Agreement.

The word "principal" has been subject to debate on what really it means after two senior politicians, both professors, argued on who must be in Government as a principal representing the smaller faction of the Movement for Democratic Change.

Making submissions during the application for confirmation of an interim order interdicting Professor Arthur Mutambara from masquerading as the leader of the MDC in the Government of National Unity, advocate Adrian De-Bourbone said:

"The word principal is a term of art which applies to the three senior members of the Global Political Agreement (GPA) representatives who are delegated by their respective parties.

"A principal is so because of not the office of the State but that of the Party. "The terms principal is for presidents, Prof Mutambara is not a principal because he is no longer a head of any of the parties signatory to the Global Political Agreement," he argued.

The power wrangle between Prof Mutambara and Prof Ncube over the leadership of the MDC started soon after the 7-9 January 2011, in which Prof Mutambara was not nominated and also chose not to contest the elections.

After that, Prof Mutambara and other 13 members of the MDC, approached the High Court of Harare seeking an order nullifying the Congress results arguing that procedures at the congress were not properly followed. The matter is yet to be concluded.

Thereafter, Prof Ncube dragged Prof Mutambara to the High Court of Bulawayo on an urgent basis seeking an order barring Prof Mutambara from masquerading as the leader of MDC.

The order was granted on an interim basis and is yet to be confirmed. If confirmed Prof Mutambara will have to exit the office of the Deputy Prime Minister of the Republic of Zimbabwe and make way for his nemesis - Prof Ncube.

The matter was postponed indefinitely.
