A 73-year-old Harare man, Million Donado was allegedly caught raping an 11-year-old girl in broad daylight. The girl was allegedly born HIV positive and has been on anti-retroviral therapy since birth but its unclear if Donado was aware of this.
The incident occurred on November 12 when the girl was sent by her brother to fetch water from Donado's well within his premises.
The court heard, Donado left his walking stick outside the house by the door, allegedly grabbed the girl by her hand and dragged her into his house where he tied her hands together with a piece of cloth, blindfolded her and gagged her mouth with pieces of cloth.
After subduing the girl, Donado allegedly forced her to the ground, removed her clothes and started sexually molesting her.
It is alleged the complainant's brother started looking for her in vain. He called out her name, but she did not responded prompting him to carry out a search.
The brother told the court: "I got curious when I saw his walking stick outside his house."
He said he became suspicious that something was amiss and decided to investigate.
Upon opening Donado's door, the complainant's brother caught Donado in the process of allegedly raping his sister. The court heard Donado panicked, stood up, zipped up his trousers and offered the complainant's brother five rand pleading with him not to report the matter.
The brother told the court he untied his sister, took her home and used the money to buy cellphone airtime before calling his mother and informing her of what had transpired.
The mother told the court she eventually reported the matter to the police, leading to Donado's arrest. When she was asked by prosecutor Sarah Bosha whether the complainant was tested for any sexually transmitted disease, she replied: "My child has been on ARVs since year 2000 when I gave birth to her."
Donado pleaded not guilty to the rape charge when he appeared before regional magistrate Estere Chivasa on Tuesday this week
He was remanded in custody to next Monday for continuation of trial.
