MDC-T Bulawayo province irked by Bhunu's 20 years jail term imposed on party members

 MDC-T Bulawayo Province has said it is baffled by the ruling made by Harare High Court Judge Justice Chinembiri Bhunu  who sentenced the party members who were arrested for killing a police officer to 20 years in jail.

MDC-T Bulawayo deputy Spokesperson Felix Mafa Sibanda said the judgement by justice Bhunu is shocking indeed and has no legal bases.
                       
"There is nowhere in the world whereby three persons can throw a stone simultaneously and hit and kill a target. Even David in the Bible used a single stone single handed in killing   Goliath instantly," Sibanda said.

"The scenario between David and  three MDC convicted cadres, Lastv Maengahama, Yvonne Musarurwa and Tungamirai Madzokere  is extremely shocking.  20 years  in prison with hard labour is unbearably offside whereas there is no linking evidence of committing that  crime," he said.

"Where ever the is a  probability not factual  evidence,the "benefit of doubt"must be applied and  awarded to the accused. In this case ,the hounarable justice Bhunu faulted  by not adhering to the principles of Law, the " benefit of doubt rule."

He said Zimbabwean, English or Roman and Dutch laws observe ," the benefit of doubt" principle as to the aforesaid case  litigation and subsequent judgement.

"In conclusion, I now pin my hopes to the eminent appeal and penal pressure from the international bar of jurists and goodwill of Zimbabweans to pressurised the Zimbabwean  bench to rescue the decayed jurisprudence from miscarriage of justice by the likes of justice Bhunu," he said.
