Businessman in court for stealing

A 21 year old Mvurwi businessman was remanded in custody by a Guruve Magistrate for allegedly stealing US$7,000 at Golly's wholesale where he was formerly employed.
Magistrate Nixon Mangoti denied Simbarashe Zemba bail, he is being charged for unlawful entry with aggravated circumstances.
Public prosecutor Spiwe Makarichi told the court that on 20 March 2017 Zemba unlawfully entered into Golly's wholesale and took a bunch of money from the complainant, Rugnathji Prashant's office before disappearing.
He came again on the 22nd of March and he was captured on CCTV unlawfully entering into the same office and taking some money thereby contravening section 131 of the Criminal law (codification and reform) Act.
Zemba, through his lawyer Nancy Maboyi pleaded guilty but disputed the value of the amount and insisted that he took US$4000 which was wholly recovered by the police.
The accused applied for bail through his lawyer who argued that it was his constitutional right to be granted bail and that he was not a flight risk since he did not have a passport.

The prosecutor vehemently opposed the granting of the bail and insisted the state had a strong case which is an incentive of the accused to flee. The prosecutor added that this was likely to induce a sense of shock in the community and jeopardise public confidence in the judiciary system considering the circumstances.
The magistrate denied the bail application after analysing arguments submitted by both parties and concluded that the reasons submitted by the prosecution where compelling and they justified the continued detention of the accused
He was remanded in custody to the 6th of April for trial.
