Chihuri challenge cop’s application for review over dismissal

Police Commissioner General Augustine Chihuri and Chief Superintendant Masina has challenged the application for review filed by a police officer Tapiwa Chikukutu who was dismissed for misconduct.
Chikukutu had filed an application for review at the Bulawayo High Court challenging the manner in which he was dismissed.
In a founding affidavit filed on his behalf by Lovemore Musika, Chihuri submitted that Chitukutu filed court application for review on the October 15 2012 under cover of case number HC3526/12 and he (Chihuri) filed an opposition on October 31 2012.
"Despite the fact that the applicants (Chihuri and Masina) filed notice of opposition, to date more than 44 months later the respondent has neither filed answering affidavit and heads of argument, nor, set the matter down for hearing," reads the affidavit.
"I submit that a good case has been made for dismissal of the respondent's court application pending under case number HC 3526/12 due to want of prosecution in terms or of order 32 rule 236 as amendment by S.I80/ 2010."
