Petroleum Company sues engineering firm over $24 600 debts

A Fuel retail company Afric Oil Petroleum (PVT) Limited has sued an engineering company, Melger Engineering (PVT) Limited demanding the sum of $24 600 for fuel supplied by the company through a credit facility.
In its summons the Afric Oil submitted that it was claiming the sum of $24 600 for fuel supplied by plaintiff to defendant in terms of a thirty day credit facility agreement between plaintiff and defendant which despite repeated demand defendant has refused or neglected to pay.
It also demanded interest of the sum at the prescribed rate from October 1 2016 to date of payable in full and costs of suit.
It its declaration of the suit, submitted that in or around April 2016 plaintiff and defendant entered into a credit facility agreement in terms of which plaintiff agreed to supply defendant with fuel on credit," reads the declaration. "It was a term of the credit facility agreement that defendant would pay for the fuel supplied within thirty days of the delivery of the fuel," reads the declaration.
"Between the period extending from about April 2016 to about August 2016, plaintiff in accordance with the credit facility agreement supplied the defendant with fuel worth $24 600 in respect of which defendant has not rendered payment. Notwithstanding repeated demand defendant has failed or neglected to pay the said amount in accordance with the credit facility agreement."
The Petroleum Company asked the court to issue an order compelling the engineering company to pay the amount.
