Twine Phiri spared jail

FORMER CAPS United boss Twine Phiri was yesterday spared jail again for failing to pay maintenance for the upkeep of his children.

Phiri was slapped with a wholly suspended 10-month jail term after he accrued thousands of dollars in maintenance arrears.

Magistrate Victoria Mashamba suspended the jail term on condition that he settles the debt on or before end of September this year.

Phiri also escaped with a wholly suspended four-month jail term for failing to pay maintenance of US$895 he accrued in 2014.

In passing sentence magistrate Mashamba said there are economic challenges Phiri is facing and is no longer involved in his old businesses.

She also said Phiri is trying to make good as he is taking care of his children as well as paying their school fees.

He is also repentant and willing to pay his arrears so jailing him would be punishing his children.

During mitigation, Phiri told the court that he is now dependent on farming and would only realise money after harvesting and it is not easy to meet the deadlines.

He further said he is the one taking care of everything for his children including the rents and school fees.

Phiri has however, managed to clear US$6000 and is now left with US$845, and he was given up to end of September to pay up.

Phiri was taken to court after his wife Keresiya Phiri complained that he was not paying maintenance as per court order.
