A 23-YEAR-OLD man from Gweru eloped with a Grade Seven pupil (13) to Mutare where he had sexual intercourse with her for days before taking her as a second wife.
Stanford Gunda of Mtapa Section 4 Suburb in Gweru appeared before Midlands Provincial Magistrate Mrs Phathekile Msipa facing one count of having sexual intercourse with a minor.
Gunda was convicted on his own plea of guilty.
Mrs Msipa sentenced him to two years in prison.
Gunda will however serve one year six months after Mrs Msipa suspended six months on condition of good behaviour.
"What is aggravating is that you knew the minor was a Grade Seven pupil. You have a wife but you chose to go away with her for a month. You are therefore sentenced to two years imprisonment of which six months is suspended on condition of good behaviour," she said.
Gunda and the minor are neighbours.
The agreed facts are that on August 14 at around 7PM, Gunda called the girl outside the gate and while they were standing there, the girl's father passed by and did not say a word. The court heard that Gunda advised the girl not to return home since her father was angry.
The two went to Gunda's friend's house and slept there.
The following morning, they proceeded to Mutare where Gunda's sister resides and stayed there for two more days.
They had consensual sex.
The court heard that Gunda left the girl in Mutare at his sister's house and went to Shurugwi.
He then sent her some money to return to Gweru where they stayed as husband and wife and had sexual intercourse several times.
The matter came to light when the girl proceeded to her aunt's place of residence to inform her where she was now staying.
The girl's aunt made a police report, leading to Gunda's arrest. Ms Ndamukanei Chikuni appeared for the state.
