A 37-YEAR-OLD Mufakose man has been ordered to perform 140 hours of community service for hitting his friend with a plank before slapping him on the cheek.
Zivanai Chemugarira hit Joseph Juma with a plank on the leg after he failed to give him back his CD upon demand.
He pleaded guilty when he appeared before Mbare magistrate Isabel Nyoni charged with assault.
Zivanai was initially sentenced to six months in prison before two months were suspended for five years on condition of good behaviour.
The remaining four months were suspended on condition he performs 140 hours of community service at Mufakose Library.
Circumstances are that on September 10 around 3pm the accused person went to the complainant's house to collect his CD that he had lent him.
Upon arrival Juma could not find Zivanai's CD neither could he account for it.
Instead Juma just told Zivanai that he does not know where the CD is and Zivanai should just go get another one from where he had got the lost CD.
Juma's response did not go well with Zivanai and an altercation arose between the two leading to Zivanai slapping Juma on the face before kicking him on the left side.
In addition, Zivanai picked a wooden plank and hit Juma on the right leg and he went away.
Juma later lodged a complaint with the police leading to the arrest of Zivanai.
Juma was medically examined and an affidavit was produced in court as an exhibit.
