Injured girl's family sues Bravo for $170,000

A BULAWAYO man whose daughter was injured when a Bravo bus she was travelling in was involved in an accident along the Bulawayo-Victoria Falls road last year, is suing the bus company for more than $170 000 in damages as well as medical and hospital expenses.
The driver of the Bulawayo-bound bus, identified in court papers as Mr Brian Mavhima, lost control of the bus and it veered off the road and overturned resulting in Buhlebenkosi Tshuma (7) sustaining injuries.
The accident occurred last year on November 26, 2016.
Buhlebenkosi's father, Mr Nkululeko Tshuma through his lawyers, Nyawo Ruzive Legal Practice, filed summons at the Bulawayo High Court citing Bravo Tours (Pvt) Ltd as the defendant. In papers before the court, Mr Tshuma said his daughter suffered a permanent disability after her left arm was amputated.
He is demanding $170 602,82 from the bus company being damages for pain and suffering, permanent disfigurement, trauma and psychological stress, loss of future earning capacity and medical expenses incurred. He accuses the driver of negligence and recklessness.
"The plaintiff has solely borne ancillary costs and medical expenses for his minor child since the time of the accident to date. Both the plaintiff and his daughter were traumatised and have suffered emotionally as a result of the accident," said Mr Tshuma.
"My daughter, who was born normal, has also suffered emotionally and has been traumatised by the fact that she has lost her limb. She will require lifelong orthopaedic care and psychological support," he said.
The girl now has a functional percentage disability of 50 percent.
"Wherefore plaintiff prays for $170 602,82 being total amount of damages suffered and to be borne by my daughter as a result of the bus accident caused by the defendant's negligence," said Mr Tshuma.
The bus company has not yet filed a notice to enter an appearance to defend the summons.
