Property dealer sued for over $14 000 debt

A PROPERTY firm, Ihawu Holdings (Pvt) Limited has been sued over $14 900 paid by a homeseeker in a property purchase deal that fell through.

A Bulawayo resident, Felicity Nyathi filed summons at the Bulawayo High Court, citing Ihawu Holdings, as the defendant in which the plaintiff was claiming payment of $14 900, as refund for the money paid for the purchase of a house.

"The plaintiff has instituted proceedings against you claiming refund in the sum of $14 900," the summons read.

In declaration of the claim, Nyathi submitted that sometime in September 2017, he paid Ihawu Holdings $14 000 for the purchase of a house in Mpopoma, Bulawayo.

"On September 23, 2017, plaintiff acting on the advice of the defendant duly paid the sum of $900, which was meant for the administration fees for the sale transaction.

Due to reasons best known to the defendant, the sale transaction did not materialise and he sought a refund. Defendant duly agreed to refund plaintiff," the declaration read.

Nyathi submitted that the purported funds transfer to his lawyer's account had not happened, prompting him to file summons against the firm.

"Plaintiff prays for payment of the sum of $14 900 within 48 hours of granting this order, interest on the sum of $14 000 from the date of summons to date of payment in full and costs of suit against the defendant on a higher scale," the declaration read.

The firm is yet to respond to the summons.
