Businessman wants $1,6m garnish order effected

A Mutare businessman, Tendai Blessing Magwiro has approached the Sheriff of the High Court instructing him to garnish $1,6 million owed to him by the Ministry of Home Affairs and Culture in compliance with Justice Clement Phiri's order.
Two days ago, Mangwiro won a garnish order against the Ministry of Home Affairs and Culture, which is to be enforced by the Ministry of Finance and Economic Development.
In the letter written by his lawyer, Mr Rungano Mahuni of Mahuni Gidiri Law Chambers this Wednesday, Mangwiro instructs the sheriff to ensure the money garnished from the ministry is deposited into his and his lawyer's account.
Mr Mahuni said he is confident that the court order will be complied with in line with observance of the rule of law under the new dispensation.
Magwiro's money was seized by the police in 2008 and after his acquittal, the police refused and failed to reimburse him.
He has been battling to recover his dues unsuccessfully for the past 10 years but the latest court order instructed the Ministry of Finance and Economic Development to garnish the Home Affairs and Culture Ministry or pay him from the budgetary vote.
