A NYAZURA man who attacked his rival with a knife following a headman-ship wrangle, ripping open his stomach and exposing intestines has been convicted of murder by a senior Mutare High Court judge.

Luke Mungoza was convicted of murder as defined in Section 47 (1) (a) of the Criminal Law (Codification and Reform) Act Chapter 9: 23 when he appeared before Justice Hlekani Mwayera.

He was slapped with a 10-year jail term. Ms Jane-Rose Matsikidze prosecuted.

The court heard that the suspect was the chairman of Romsley resettlement area, a post that replaced the traditional role of the village head which was held by the deceased Trymore Chivandire's father.

Apparently, the Chivandire family was aggrieved by the dislodgment of their father as village head.

Ms Matsikidze said the deceased usually confronted the suspect over the case resulting in Mungoza getting a protection order to bar the deceased from harassing him.  "On January 10 last year at Tsungwesi Business Centre in Odzi, the rivals met in a shop where they separately bought alcohol generally known as Super. Chivandire was belligerent towards Mungoza who however remained quiet. Mungoza walked out of the shop and the deceased followed him. After a while the deceased cried out saying he had been," said Ms Matsikidze.

It was later discovered that Mungoza had attacked the deceased with a knife and ripped open his stomach.

When fellow patrons gathered, Mungoza told them that the deceased had pestered him for too long.
