A Harare woman last week sent the court gallery into uncontrollable roars of laughter after she claimed maintenance for an unborn child. Natasha Tasiyana made the shocking claim at the Harare civil court where she was claiming maintenance from the father of the child to be, prosper Murefu.
Magistrate Mirriam Banda however told Natasha that maintenance is only claimed for LIVING children.
" You can not claim maintenance for an unborn child and we therefore exclude that and deal with the other child," said Banda.
Natasha told the court that Prosper is also not looking after the other minor child. She was accusing the respondent of neglecting her along with their son and her pregnancy.
"I want him to give me US$300 per month for our minor child and the one who's coming soon. He is not looking after me and is not even caring that I am pregnant. I tried to explain to him before and I approached the court after I realised that he is not even worried," she said.
Responding to the claims, prosper said he can not afford to pay the amount requested by the applicant. He said he is also looking after his siblings since their parents passed away."Your Worship, I earn US$374 per month and I can not afford the US$300 that is being requested. I also have other responsibilities," he said.
Magistrate Banda granted ruling in the applicant's favour and prosper is to pay US$90 as monthly maintenance.
