New Marriages Bill approved...formally bans gay marriages

President Emmerson Mnangagwa's Cabinet on Thursday approved the Marriages Amendment Bill which seeks to repeal and replace the Customary Marriages Act (Chapter 5:11) so as to emerge with one Act governing marriages in the country.

The new Act will also update the law in line with the Constitution.

Cabinet said the objectives of the Bill are:

1.    Ensuring gender equality

2.    Recognising the rights of women, youth and children

3.    Recognising the rights of cultural groups and the preservation of cultural values an practices which enhance the well being of a people.

4.    Providing full consent to marriage by intending couples.

5.    To accord the primacy of the best interest of the child.

6.    Prohibition of same sex marriages.

7.    And the recognition of the Supremacy of the constitution which invalidates any law, practice and conduct inconsistent with the constition.
