A GWANDA mechanic has been ordered to pay a $300 fine after he ran over and killed a passenger who had dropped off from his vehicle.
Calvin Sayi (31) of Marriage Suburb was convicted on his own plea of guilty to culpable homicide by Gwanda magistrate, Mrs Nomagugu Sibanda.
He was ordered to pay the $300 fine by 24 June or spend two months in prison in case of default. In addition, Sayi was sentenced to six months imprisonment which were wholly suspended on condition he does not commit a similar offence within the next five years.
Prosecuting, Miss Faith Mutukwa said Sayi ran over and killed Wellington Moyo on 26 February 2017 at around 3am.
"On 26 February 2017 at around 3am, Sayi was driving his motor vehicle a Toyota FunCargo with four passengers onboard including Mr Wellington Moyo who had hired him to take him to his place of residence. Upon reaching his house, Moyo disembarked from the vehicle and Sayi followed him out in order to collect his fare for the hire. Two other passengers who were also in the vehicle followed the two men outside and found Sayi arguing with Moyo over the payment," she said.
Miss Mutukwa said Sayi and the other passengers later went back into the vehicle leaving Moyo outside. She said Sayi started the motor vehicle and reversed without checking behind and knocked Moyo down. Miss Mutukwa said Sayi dragged Moyo for a distance of about 28 metres and then sped off from the scene, leaving Moyo behind. She said Moyo died on the spot and the matter was reported to the police resulting in Sayi's arrest.
In mitigation, Sayi said he did not run over Moyo on purpose. He said after dropping off Moyo, he also disembarked from the vehicle to talk to him as he was refusing to pay. Sayi said when he returned to the car and reversed, he did not realise that Moyo who was heavily intoxicated had passed out while he was standing behind the vehicle. Sayi said he immediately stopped after realising that he had hit someone.
