A Harare woman, Mrs Maria Derrica is seeking divorce and assets worth over $1,2 million from her husband whom she accuses of developing an improper relationship with their adopted daughter.
Maria has been married to Mr Jose Carlos Rodrigues Derrica for more than a decade but says their relationship has irreversibly broken down. She alleges that her husband has an improper relationship with their adopted daughter, Ayla Blancahrd, but Mr Derrica strongly denies the allegations, dismissing them as false.
According to a letter of demand from Mrs Derrica sent through her lawyer Mr Jonathan Samkange of Venturas and Samkange, she is seeking immediate divorce and the liquidation of the couple's business interests, which include fast food franchise Chicken Hut.
"We have received Instruction from our client Maria Margarida Derrica who has advised us to institute divorce proceedings and claim her equal share of the matrimonial property and business. Our client's instruction is to liquidate the business and claim her 50 % share of the proceeds thereof," reads part of the letter.
Maria alleges that she had endured severe depression because of the alleged improper relationship between father and daughter adding that the two heaped further stress on her after they embarked on a spending spree that saw Mr Derrica transferring some equity to Ayla.
"The grounds of divorce are that you have engaged in an improper relationship with your adopted daughter Ayla Blanchard. You have in the process engaged in unlawful practices such as the transferring of our clients' shares to Ayla Blanchard without our client's consent and authority, and spending our client's money without her authority," said Maria.
In response, through his lawyers, Costa and Madzonga, Mr Derrica conceded to the divorce but denied having an improper relationship with his daughter.
"The allegation is false ad motivated by a sense of perceived insecurity on the part of Mrs Derrica. We are reliably informed that the daughter has a long time boyfriend and she is intending to move out to join him in the near future ," reads part of the response.
Mr Derrica also called for a proper valuation of the couple's wealth before the assets are divided.
