Man beats his jailbird brother to death, acquitted

A 45-year-old Nyajena man who pummeled his jailbird brother to death with a hoe handle last Tuesday walked out of court a free man after a High Court judge ruled that he had acted in self defence.
Justice Charles Hungwe sitting at the High Court on circuit here, freed Fanuel Madoro of Shambani village who was facing murder charges.
He was accused of killing his brother in June 2009. Pedzisayi Madoro had confronted Fanuel armed with a pick threatening to kill him for telling police on his whereabouts.
Fanuel however, hit his brother with a hoe handle leading to his death.
However, Justice Hungwe sitting with assessors, Mr Eliphas Gweru and Mr Postal Dauramanzi spared Fanuel jail after he acquitted him.
He ruled that had acted in self defence.
