Man jailed for raping mentally ill sister

A CHIVI man was slapped with an effective nine year jail term for raping his mentally challenged sister and threatening to kill her with a knife and feed her head to the dogs if she reported the case to anyone.
The accused, Aspect Sekenya (20), of Gwamure Village, Chief Gororo in Chivi, was sentenced to 12 years in prison of which three years were suspended for five years on condition he is not within that period convicted of a similar offence when he appeared before Masvingo regional magistrate, Ms Esther Muremba, for contravening Section 65 (1) of the Criminal Law (Codification and Reform) Act Chapter 9:23, rape.
Sekenya pleaded not guilty to the charges. He will, therefore, serve an effective nine- year prison term for the offence.
Presenting the State case, the prosector, Mr Frank Chirairo, told the court that sometime last year at around 6pm, the 28-year-old complainant who is mentally challenged, was on her way back from where she had been sent by her grandmother when she met Sekenya who happens to be the complainant's brother.
Sekenya held the complainant by the hand and tried to talk her to consent to sex but she declined. He persisted and the complainant became agitated and tried to break loose from the accused's tight grip.
The court heard that the accused maintained a vice-like grip on the complainant's hand and later dragged her to a nearby maize field where he raped her once.
It was the State case that after raping the complainant Sekenya threatened to slit her head with a knife and give it to dogs if she reported the case to anyone. However his threats fell on deaf ears as she went and narrated the events to her grandmother upon getting home.
Her grandmother later reported the case to the police at Ngundu leading to the arrest of Sekenya and his subsequent appearance in court where he was not represented.
The magistrate said a lengthy custodial sentence was appropriate as it would send shivers down the spine of would-be offenders. sunday news
