A 77-YEAR-OLD Buhera grandfather was on Wednesday sentenced to 18 months in jail for assaulting his granddaughter to death over allegations of indiscipline.
Nyasha Gwese of Rusere village under Chief Nyashanu was convicted of culpable homicide by High Court judge Justice Susan Mavangira sitting in circuit in Mutare on Wednesday.
He will, however, serve an effective six months after 12 were suspended on condition he will not commit a similar offence in the next five years.
According to the State, on September 23 2009 at around 10pm, Gwese returned from a beer drinking binge and decided to discipline the minor whom he had accused of bringing the family name into disrepute.
He proceeded to the girl's bedroom, dragged her out and tied her onto a tree with a rope.
The State submitted that Gwese took out a leather rope and started assaulting the juvenile on the head for about 10 minutes before retiring to bed leaving her tied on the tree for the night.
At around midnight, her aunt came to investigate after noticing that she had not returned to bed.
The aunt found the juvenile dead and still tied to the guava tree.
A police report was made, leading to the arrest of Gwese.
A post-mortem report showed that the juvenile died as a result of head injuries.
In passing sentence, Justice Mavangira said Gwese had overreacted and deserved custodial sentence. Jane-Rose Matsikidze prosecuted.
