A caretaker at Chalkmead Flat in Greendale, who swindled Shurugwi South legislator Anastancia Ndlovu of US$800, has been ordered to perform 315 hours of community service for theft.

In addition, Pernshewince Gumbani (22) was ordered to restitute US$800 to Cde Ndlovu by December 31. Ndlovu gave Gumbani US$800 to hand over to an agent, Natso Mbire of Sub-Saharan Real Estate, as monthly rentals.

He converted the money to his own use.

Gumbani refuted the charges, but Harare magistrate Ms Anita Tshuma convicted him after a fully-contested trial and sentenced him to one year in jail.

Three months were suspended for five years on condition Gumbani does not commit a similar offence within that period.

A further three months were set aside on condition Gumbani restitutes Ndlovu.

The remaining six months were suspended on condition he performs 315 hours of unpaid work at a public institution.

In passing sentence Ms Tshuma noted that it was absurd to assume that Ndlovu fabricated charges against Gumbami. Gumbani denied the charge claiming that that he never seen the money. He said he delivered an envelope that contained the money to Mbire without opening it.

Ndlovu had told the court she sealed the money in an envelope together with a 25-litre fuel coupon in the presence of Gumbani and then gave it to him. Prosecutor Mr Tungamirai Chakurira appeared for the State.
