HIV+ man deliberately infects girl (16)

A RUSAPE man (28) is alleged to have taken advantage of a teenager (16)'s innocence to indulge in unprotected sex with her, thereby deliberately infecting her with HIV.
This emerged during the trial of Panganayi Mudzingwa (28) of Vengere high-density suburb who appeared before Rusape provincial magistrate, Mr Shingi Mutiro for deliberately infecting her with HIV.
Mudzingwa is alleged to have contravened Section 79 of the Criminal Law (Codification and Reform) Act Chapter 9. 23, which makes the deliberate infection of HIV criminal.
Appearing for the State, Mr Gift Chokodza, said: "Accused and complainant were lovers and sometime in April 2012 at Flyover they slept together and accused deliberately transmitted HIV to the complainant.
"When the complainant's mother discovered that Mudzingwa was in love with her daughter she then took her to hospital for an HIV test where it was discovered that she was positive."
Mudzingwa, a self actor pleaded not guilty to the offence.
In his defence, Mudzingwa said he had never slept with the girl although they were lovers. He also accused the girl's parents of forcing her to make a false report against him.
The girl was called to testify and told the court that she had several unprotected sexual escapades with Mudzingwa whom she said was her first sexual partner.
"We used to have unprotected sex with him twice a day usually at the flyover. I then discovered that I had developed some painful wounds on my genitals and my mother later accompanied me to hospital for medical examinations where my HIV status was confirmed," the girl told the court.
The matter was adjourned to February 7 when Mudzingwa is expected to cross-examine the girl.
